Film i Skåne’s legal framework concerning co-production of film and TV series

Film i Skåne acts as a co-producer with requirements for expenditure of funds in the Skåne region and rights in the film productions we participate in. Below, film also refers to TV series.

Co-Production and Co-Production Agreements

Film i Skåne cannot participate in films whose production has already started or where a co-production agreement has already been negotiated unless the co-production agreement is dissolved and renegotiated between all parties.

The film’s producer shall prepare a draft co-production agreement to be negotiated between all co-producers. The agreement shall include the script, budget, liquidity plan, and other agreements regulating the film production, its rights, and its distribution and/or sale. Film i Skåne’s regulations shall be attached as an appendix to the co-production agreement and signed by all co-producers. The film’s producer must provide written proof that the project’s entire financing has been secured.

Expenditure of Funds in the Skåne Region

Expenditure in the Skåne region refers to costs incurred for salaries to persons residing in Skåne or purchases of goods and services from companies based in Skåne with employees in Skåne in connection with the film’s production. Purchases of consumables in connection with the film’s production count as expenditure provided the purchase address is in Skåne.

The co-production agreement shall specify how much the film’s producer commits to spending on costs in Skåne. The producer shall ensure that costs incurred in Skåne are specifically marked in the accounting and separately reported in the final report of the film project. In some cases, funds spent in individual municipalities may also need to be separately reported. The co-production agreement shall also regulate what happens if the producer does not fulfill their commitment regarding expenditure in Skåne.

Film i Skåne prioritizes films with high expenditure in Skåne.

Rights and Revenue Requirements from the Film’s Exploitation

Film i Skåne shall have a share of the revenues from the film’s exploitation on the same terms as other co-producers, based on the principle of pari passu and pro-rata distribution relative to the co-production capital.

Rights and Requirements for the Use of PR and Marketing Materials Produced for the Film

Film i Skåne shall have the right to show the film at non-commercial events organized or participated in by Film i Skåne without rental costs. Film i Skåne shall have the right to freely make short excerpts from the film and delivered press materials, including still images, available on the internet and in marketing materials for its own promotional activities.

Rights to Use the Film in Film Education Activities

Film i Skåne works through educational activities to increase knowledge about film and media. This work is carried out through teaching and lectures as well as through a film experience center within Ystad Studios. In these contexts, Film i Skåne shall have the right, in consultation with the main producer, to show short excerpts and still images from the film’s production and geographically indicate where the film was shot.

Film i Skåne shall be able to make parts of the film’s script available as comparison material between the script and the finished film. Film i Skåne shall have the right to, at its own expense and at a time that does not hinder production, document studio environments and, with permission from third parties, locations used in the film. This documentation may be used in the film experience center as backgrounds for creative work and in Film i Skåne’s other educational activities.

After consulting with other co-producers and upon completion of filming, Film i Skåne shall be able to take over parts of props and studio constructions to be used in the film experience center. Film i Skåne shall, at a time that does not hinder production and after consulting with the film’s producer, be able to exhibit studio environments built for the film in Ystad Studios.

Film i Skåne shall, after consulting with other co-producers and obtaining approval from the concerned actor as well as making a specific agreement on compensation, be able to make short excerpts from the film or newly filmed sequences available for the film experience center’s creative activities.

Credits

Films in which Film i Skåne has participated as a co-producer shall clearly state in the main credits that they have been produced in co-production with Film i Skåne. Film i Skåne shall be credited in the same place and in the same manner as other co-producers, which also includes the use of logos in end credits and marketing materials produced for the film. Film i Skåne’s commissioning editors shall be credited in the film’s end credits.

If the film is shot in Ystad Studios, this shall be indicated in the film’s end credits. The film’s opening and end credits shall be submitted for approval to Film i Skåne.

Film Premiere

Films co-produced by Film i Skåne shall have a special cinema premiere in the Skåne region. The premiere shall take place in the municipality where the majority of the filming occurred. The Skåne premiere shall take place before the film’s national premiere. The film’s producer shall be responsible for planning and executing the premiere.

Delivery

The producer shall deliver the film as a digital file according to the instructions agreed upon in the co-production agreement, without cost to Film i Skåne. Together with the film, production facts and synopsis, teaser and trailer, press images, and posters shall be delivered. If the film is produced in physical copies, such copies shall be sent to Film i Skåne without cost.

Environmental Policy

Film i Skåne works to make film production more sustainable. To obtain metrics and disseminate knowledge, Film i Skåne uses the tool Hållbar Film (Sustainable Film). The film’s producer shall, after being instructed by Film i Skåne, undertake to fill in information about the film in a digital form provided by Film i Skåne.
